1. Introduction

Welcome to Berniture. By accessing or using our website (berniture.com), mobile application, or any of our services, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, you must not use our platform.

Berniture reserves the right to modify these Terms at any time. Changes take effect immediately upon publication on the site. Continued use of the platform constitutes acceptance of the updated Terms.

2. Eligibility & Account

You must be at least 18 years of age to use this platform. By using Berniture, you represent that you meet this requirement or are accessing the site under the supervision of a parent or legal guardian.

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. Berniture shall not be liable for losses resulting from unauthorized account access caused by your failure to safeguard your credentials.

Each customer is permitted one account only. Creating multiple accounts may result in permanent blacklisting and legal action.

3. Use of the Platform

We grant you a limited, non-transferable, revocable license to use the platform for personal shopping purposes only. Commercial use or use on behalf of any third party is strictly prohibited unless expressly authorized by Berniture in writing.

You agree not to:

•       Use the platform for any unlawful or fraudulent purpose

•       Attempt to reverse-engineer, scrape, or reproduce any part of the platform

•       Interfere with or disrupt the security or availability of the platform

•       Misrepresent your identity or impersonate any other person

4. AR & 3D Visualization Disclaimer

Berniture offers Augmented Reality (AR) and 3D product visualization features to help you preview furniture in your space before purchasing. Please note the following important limitations:

•       AR and 3D renderings are approximations only and may not perfectly reflect the actual product's color, texture, material finish, or dimensions.

•       Real-world colors may vary due to differences in screen calibration, ambient lighting conditions, and material properties.

•       AR placement accuracy depends on your device's camera, surface detection, and available lighting. Results may vary across devices.

•       The 3D model is provided as a visual guide. The product description and specifications listed in writing shall take precedence in case of any discrepancy.

We recommend always reading the full written product description before placing an order. If you require precise color or dimension matching, please contact our customer service team for physical samples where available.

5. Product Representations & Pricing

Product descriptions, images, and pricing information on berniture.com are provided in good faith and are subject to change without notice. Berniture strives for accuracy but does not guarantee that all information is error-free.

In the event of a pricing error or mislabeled product, Berniture reserves the right to cancel any order placed at the incorrect price, notify the customer, and offer the option to re-order at the correct price.

All prices are listed in Egyptian Pounds (EGP) unless otherwise stated. Prices are inclusive of applicable taxes unless noted.

6. Orders & Payment

6.1 Order Acceptance

Placing an order on Berniture constitutes an offer to purchase. We reserve the right to accept, reject, or cancel any order at any time, including after confirmation, for reasons including but not limited to: product unavailability, pricing errors, or suspected fraud.

6.2 Payment Methods

Berniture accepts the following payment methods:

•       Debit / Credit Cards (Visa, Mastercard)

•       Cash on Delivery (COD) — subject to availability and applicable conditions

•       Bank Transfer — available in special cases upon arrangement with our finance team

•       Installment Plans — where applicable and as listed on the product page

6.3 Down Payments

For custom-made or made-to-order products, a down payment is mandatory regardless of the payment method selected. The required down payment percentage will be communicated at the time of order.

6.4 Payment Security

To protect against fraud, Berniture reserves the right to request identity verification, address confirmation, or banking information before processing payment. Failure to provide verification within 2 business days may result in automatic order cancellation.

Credit card payments are processed through our contracted Payment Service Provider. Berniture does not store full card details on its servers.

7. Delivery & Receipt

Berniture delivers to private addresses only — including home and work addresses. Deliveries cannot be made to public places, streets, cafes, restaurants, or any non-private location.

For orders paid by credit card, the delivery recipient must be the cardholder and must present a valid National ID to our delivery driver upon receipt.

Delivery timelines are estimates and may vary due to product availability, location, or unforeseen circumstances. Berniture will communicate any significant delays.

Ordered items are subject to availability at the time of shipping. In rare cases, items may become unavailable between order placement and shipment. In such cases, the customer will be notified and a full refund will be issued.

8. Returns & Refunds

8.1 Cash on Delivery Orders

In the event of a return where the original payment was made via Cash on Delivery, the customer is eligible for a cash refund within 10 days of the return being processed. If the customer is unreachable within 10 days, the refund will be issued as a store voucher and cannot be converted back to cash.

8.2 Credit Card Orders

For cancellations (change of mind) on credit card orders, refunds will be processed back to the original card within 7 to 14 working days, after deducting applicable bank transaction fees.

8.3 Custom & Made-to-Order Products

Custom and made-to-order products are non-refundable once production has commenced, except in cases of manufacturing defects or incorrect items delivered.

9. Data Privacy & Personal Information

Berniture collects personal information necessary to process your orders and improve your experience. This includes your name, phone number, email address, delivery address, and payment details.

Your data is used to:

•       Process and fulfill your orders

•       Send order confirmations and updates via email or SMS/WhatsApp

•       Provide personalized product recommendations through our app

•       Improve our AR and shopping experience

Berniture does not sell or share your personal data with third parties for marketing purposes. Your data is shared only with service providers necessary to fulfill your order (e.g., delivery partners, payment processors).

You may opt out of promotional communications at any time by clicking the unsubscribe link in any email or contacting our support team.

10. User Submissions & Reviews

Any content you submit to Berniture, including reviews, comments, or suggestions, becomes the exclusive property of Berniture and will not be returned. By submitting content, you grant Berniture the right to use your display name in connection with that content.

You agree not to submit false, misleading, or defamatory content. Berniture reserves the right to remove any submission at its discretion without obligation.

11. Vouchers & Promotions

Vouchers are issued per customer and may only be used once. Misuse of vouchers — including use across multiple accounts — will result in:

•       Permanent blacklisting of the customer's account

•       Inability to place future orders on berniture.com

•       Potential legal action by Berniture's legal team

Berniture reserves the right to cancel any order and revoke any voucher if abuse is suspected.

12. Intellectual Property

All content on berniture.com — including text, graphics, logos, software, 3D models, AR assets, photographs, and their arrangement — is the exclusive property of Berniture and is protected under Egyptian copyright law and applicable international conventions.

You may not reproduce, distribute, or create derivative works from any Berniture content without prior written permission.

13. Limitation of Liability

Berniture provides its platform and services on an 'as is' basis. To the maximum extent permitted by applicable law, Berniture disclaims all warranties, express or implied, including fitness for a particular purpose.

Berniture shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to: loss of data, AR rendering inaccuracies, delivery delays, or third-party service interruptions.

14. Dispute Resolution & Arbitration

Any disputes arising from these Terms or your use of Berniture shall be resolved through binding arbitration. The arbitration shall be conducted by a single arbitrator appointed in accordance with the rules of the Cairo Regional Centre for International Commercial Arbitration (CRCICA).

The arbitrator shall be legally trained with experience in e-commerce or information technology, and shall be independent of both parties. The arbitration venue shall be Cairo, Egypt. Proceedings shall be conducted in Arabic and/or English.

The arbitrator's award shall be final and binding, enforceable under Egyptian Arbitration Law No. 27 of 1994. Berniture reserves the right to seek injunctive relief through competent courts to protect its intellectual property rights.

15. Governing Law & Jurisdiction

These Terms and Conditions are governed by and interpreted in accordance with the laws of the Arab Republic of Egypt. Both parties agree to submit to the exclusive jurisdiction of the Egyptian courts.

Berniture is a company registered in Egypt. International credit card payments processed through our platform are handled by our contracted payment service provider.

16. Termination

Berniture may terminate or suspend your access to the platform at any time, without notice, for conduct that violates these Terms or is harmful to other users, Berniture, or third parties. Upon termination, your right to use the platform ceases immediately.

If you are dissatisfied with the platform or these Terms, your sole remedy is to discontinue using the site.
